Ok, let's get to the noose labour day is the traditional kick off to the final stretch of any campaign and even though we're heading into twenty twenty two, the conversation this week has been dominated by Joe Biden and donald trump, who just held dueling speeches in pennsylvania. One of the judges trump appointed also granted his request for a special master to review all the documents. The f b I found in his beach house, which will have the effect of temporarily pausing the investigation into the.
Only twenty four republican front runner, who, according to a new, wash and impose story this week, had been hiding highly classified information about a foreign governments, nuclear weapons, pro
graham, in mar a lago as well as documents so secret that only the president and a few cabinet members could authorize other government officials to know about them. Naturally, trump is doing what any good strategist or lawyer would tell a candidate to do who is under criminal investigation for stealing nuclear secret
he's making it part of his stumps beach. Let's take a lesson: the fbi and the justice department that become vicious monsters. It was
just my home. That was rated last month. It was the hopes
dreams of every citizen who I've been fighting for since the moment I came down the golden escalator. The moral mar reg was a desperate effort
You distract from Joe Biden record of misery and failure.
You know this week, Joe Biden, game to philadelphia, pennsylvania,
I had to give the most vicious hateful and divisive speaks ever delivered by an american president.
Buying seventy five million citizens as threats to democracy and as enemies.
Estate, you're, all enemies of the state he's an enemy of the state. You want to know that for the fbi I didn't just read,
calm down. They raided your hopes and dreams. I love that part is terrible. Speechwriter are lots to unpack there. Let's start with judge, I ween cannons decision to stop. Investing
station until especial master can look through all the documents they found in marilla, go and separate the the nuclear secrets trump stole from his his old porn stash. What what wouldn't bucks
Are they gonna do well? What are you
of the ruling. What happens now? Well,
As we have stipulated every episode
since we got really deep into trumps crimes of last month. Yours I we are now amateur lawyers. Now we are not liars right, we buy.
Do you follow a lot of wires on twitter yeah, so I feel like I can speak with some authority on this matter. Let me tell you they are outraged that, in some of your favorites twitter lawyers think this ruling is bullshit
including new attorney general of resistance station gulbarga he its absurd. He called it a crock, a shit bill, bark all that a crack, a shit, this ruling, that's what you need
no reused zero bill. Barr get your bobblehead doll, get your votive candle with bill maher on it.
we're gonna mother da we're gonna crisper ray we're gonna, be required. All begin
eric hersman doll. Eddie have been this. You don't we
I even have to be a lawyer or even follow top wires on twitter to understand why this ruling is idiocy, because one of the main, though you have a huge debate about whether executive privilege, which is that
he's in for the special master this rather than go through these documents to see which might be subjected privilege? Now it's
stipulating that executive privilege is no reply to former presidents. It's really doesn't apply to
it's moving within the executive branch, which is where the fbi and the court of justice is
What might there's like a factual, a massive, factual error, this willing, where it says that president Biden did not
and because of the sitting president makes traditions unacceptable because they are the executive, not the fucking yahoo, when the beach house ah
whether he had not waited on whether executive privilege could be claimed here, but he did in the letter from the archivist that why that trumps team foolishly really released last month, and so with this- is just a bunch of idiocy
The impact of this is everyone has heard of written. Is this will the way, but not necessarily derail the
investigation. But the delay does matter because if it kicks it down the curve for a long time,
to be put in a position where the context in which a potential indictment could be announced is an image of a presidential
which he should not be more complicated. There is no special provision,
in the law that says, if you're running for president, you can't go to jail for crimes you committed, but, as we know, everything is political and that will add some of the complications of such an announcement. If that were to happen, our our boy, Billy Barr, has said he's he's like pretty certain. This would be. Over
turn, because, like that, the two does know how crazy the executive, the executive privilege ruling is here. The ruling about of executive privilege that there is
some dispute over, like whether former presidents can ever have a claim of executive privilege, but the ruling of that state. The supreme court ruling that's based on, took place before the presidential records act was passed into law. The presidential records act makes very very clear what you just said, which is that the current president gets to decide what documents are privileged or not, not the former president. So now, if you get a special master, first of all, you have to have to find a special master. You have to have both sides.
Agree on candidates to be this person. The person has to be classified at the highest level in order to even see some of these documents, and then this person has to make some determination about which documents are privilege in which are
even though the law does not spell that out at all, because the law says that nothing's privileged because Joe Biden gets to make the privilege make the decision on privilege. So it's like preposterous, so the the the government, the d o j, has and hasn't as an option. They either go down this route, trying to find a special master with all those qualifications. Who can do that, which seems very very difficult, but they, I guess they have to this friday- both sides to come up with a list of special potential special master candidates, a grin or the d o J appeals. This ruling to the eleventh circuit and now the issue there is the eleventh circuit has eleven judges
Sir trump appointed judges in five five or not, but people like you, like even you, know very conservative people- a bill bar think that, even though there are other trump judges on this on the Sullivan circuit court, there's no way they would uphold. This will say
there's an interesting story in the new york times a day about the dilemma the justice department has yeah, which is, I think, they believe on the merits. They would win this and win it easily, but there are two challenges
soon if your wine
Further delays, especial master right issue and there
The concern that you could just get a run of trump judges running up to the trumps Supreme court, which can create an entire
absurd new expansion of executive power to include former presidents, and so there is. There is a potential
challenge to their so that they might be really have, even if they're gonna percent right on the merits? There are times
and larger issues beyond trump after russia, with as it make this decision, but it seems
Figure on it, they're going to have to appeal, because even if they don't want to criminally charged trump, the national intelligence assessment of the damage and the fallout from trump having these secrets can't even continue. The judge said it's technically can continue, but in all reality like you, can't do a fair assessment of this. If, like the d o J and the f b, I can't be involved in looking at the documents and help with the investigation into what damage has been done from trump holding these documents, like it's, not there's, there's they're trying to build a fake wall between the intelligence officials and the justice department officials and saying that the intelligence officials can keep going with the investigation, but the justice, dept
I can't, but in reality that doesn't work so like if they want to do this assessment, which they have to for national security reasons they're going to have to appeal. This is so. The whole thing is so stupid
Then the fact out, Jim s place is so damn it has nothing to do with heed the point: is there not his doctor
No one has ever suggested that, MR president, there has documents he took up, he wasn't supposed to. He lied about it. He affected the investigation.
because Mitch Mcconnell ran through some fuckin yahoo to sit at the corner, moral logo or indisposition work
it is once again using the tyranny
the political minority to avoid criminal prosecution. Good argument for fighting pretty hard to keep the senate, because, even even if democrats lose the house, if we keep the senate, Joe Biden can keep nominating and confirming judges. So we don't have more fuckin trumped judges who do
yahoo rulings like this anyway, so you heard trumpet the rally he said that this right,
It was a distraction from Joe Biden's failures and called law enforcement officers, vicious monsters who didn't just raid his home again, but rated. The hopes and dreams of every citizen he's been fighting for. You think that defense works with anyone who's a not a die hard trump supporter.
Do I find it ironic that the blue lives matter? Crowd are the ones
where accusing federal law enforcement agency thing enemies in the state were planning evidence on a former president and our apparatchiks in Joe Biden, political army yeah. I find that Iraq until I think this is
We particularly persuasive for the plurality of americans, who think donald trump is dangerous and unfit for office now, but it is an argument with political power because

This is only worth being a jerk. He is trying to create a sense of grievance and victimization might have among his base to get them to turn out. I don't think it's moving any wind from the trump camp to the

While it has been for listening to republican candidates, try to defend trumps theft of highly classified nuclear secrets here,
answer from the guy who once said that donald trump can't be trusted with the nuclear codes, a storage argument that they're making their arguing their documents.

buck unreal. I dont like about the broader mid term context here: net clip we
earlier. We also heard from talk about Biden speech in philadelphia where he accused the president
a vilified millions of citizens as enemies of the state. Here's a clip from Biden speech,
Donald trump and the magyar republicans represent.
extremism that threat
the very foundations of our republic,
Now I want to be very clear right, clear up front, not every public and not even the majority. Republicans are magyar republicans, not
public and embraces extreme ideology. I know
has been able to work with these mainstream republicans, but there is no question that the republic
party today is dominated driven and intimidated by doubt
drop on the magyar republicans and that
threat to this country are right. There was an interminable amount of debate about this,
each that I'd rather not rehash for our poor listeners. I've I felt grateful. We didn't, have a pod built europe into peak
so we didn't have to talk about the fresh takes on this speech. But like let's just let's, let's go to this question, what do you think the white house strategy was with this speech primetime speech, big speech? He goes to philadelphia.
but why do you think they did it? There has been over the course of the last six or some months, the sort of debate among democratic operatives pundit.
Campaign, folks about what the farm message should be about. Should it be about what democratic delivered, what have we die?
Should it be about kitchen table issues? Should it be about january six or something else,
By giving this speech, which is to a
all to make this election or referendum on republican extremism.
The white and Joe Biden. The one I sent a message to every Democrat
recommended frankly, every report covering these campaigns, what they should be about,
They see these central issue here to be the extremism of magda republicans and it is,
like this is like what the white house can do to help enforce some sort of message. Cohesion among the party is to give a big speech.
Then primetime get a lot of attention, and I hope that everyone follows, and so I think, that's what the government was to lay their cards now for what they
I think the best messages for insult me see there's a new navigator pull out today, which in there's an awesome anew,
writers. Paul bitch both show the power of this extremism argument, and
willingness of a majority of voters to believe that reforms are dangerous extremists. Yet right,
poll. Today's taken after in the days after Biden's speech and it's interesting, fifty eight percent in the polls say that trump's make america great again. Movement is threatening america's democratic foundations. That includes twenty five percent of republicans. Some of you probably think, and only twenty five percent and it's pretty good. Ah sixty percent of republicans don't think trump's maga movement represents the majority of the party, which I thought was interesting, but then fifty nine percent said Biden speech will further divide the country, though half said that they didn't watch or follow the speech at all, which I think those numbers those sort of conflicting see.
We conflicting numbers kind of say at all, but what do you think I'd speech should be the basis for the democratic meant message I do. I think we have an overwhelming political
frankly, moral obligation to turn all of our fire power on focusing on the dangers of this republican party and its not just dangers to democracy and extremism, and these vague ways it is abortion. It is attacking.
Marriage, equality, attacking tradespeople, book bands, privatizing social security, overturning elections, all of it. I think that
We have talked a lot about how the the dogs decision has sort of
catalyze democratic movement as know we've seen the stories about people getting fired up and all, and we weren't sure what we thought would happen in kansas and in the new york special election with that ryan here:
last week, but ultimately, why the I think the dogs decision did. Is it crystallise the impact of republic
extremism and if you can convince- and I think what is important to us is that we use is that abortion is an apple,
the central issue in this race, but it is eight, it is a gateway issue into a broader conversation, republican extremism,
because if you can convince someone that earns even done
It's been informed voters that he's republicans have these incredibly extreme positions on abortion that they want when a ban it and keeps his case of rape and incest and life of the mother that they're going to so attacking ivy s in all of these
their things. What have you people understand that they are more likely to believe in. This is correctly believe that these same republicans well overthrow elections. They wall attack marriage equality. They wore eliminates of security,
we'll do all of these things- and so I believe that that that I mean we talked a little bit last week, but there was a very, very dangerous strain in this country right now and we have to call them.
Out in there is no political downside in debate and as a whole, have lotta put up cited in it yeah
This, no interesting we're we're off scripts. Do you think cause I've thought about this?
think that anyone who watch that speech who
who was an already voting for democrats, would be convinced to vote for democrats based on that speech.
I think that we that is a over. Maybe I don't. The speech is this
right now, the many people watched the speech.
There are only amount of people are who consumers this feature consuming it in
the conversation around it
most of our target. Voters will consume yet another the speech nor the conversation, and so when it's the tale effects of the message is why the view
his campaign, said John fetterman here we're going to talk to you in a little bit put in their messaging in their paid messages. That is what the
it's like no
there are no undecided voters watching wide primetime speeches other than in moments of extreme national crisis. Right, though, that like at that,
I think that's the wrong. We began it also that is it
it's an overly narrow view of politics, be like hey
I'm sorry, I'm definitely loading and I'm trying to decide between voting for doktor eyes or john fishermen. What roses
should play the other question of look at what is that speech in that, and that brought our message due to turn out more people who voted for Joe Biden and twenty twenty? Who would otherwise sit out these midterms out of complacency or lack of political engage like that? That is how to
I think more than persuading a slight narrow swath of another. Those voters aren't gonna matter, but we really just have to keep people in our camp more than take people who voted for trump and move them to our camp in order to hold the house and keep aside yeah so that I
clearly agree with. I also agree that the with the general strategy of making the twenty twenty two midterms a referendum on republican extremism, I think that's correct. I think that the headlines out of that speech, because the media is annoying but also predictable, is, like you know by
draw a line in the sand? It's it's. You know, Biden, vs, maga, and you know the hairs dark Brandon and all that bullshit. I would in a democratic message if I was wearing a democratic campaign, I do think I would try to separate. We talked about this before the speech sort of separate maga from republicans writ large. I think that's useful, but you heard Biden try to do that in the end. He did do that in the clip that we played. He specifically said. Not all republicans are mag republicans. I think it would help to be more specific and talk about maga politicians so that it's clear you're not trying to talk about voters or guess what voters might do. Are there a whole bunch of people in this country who are part of the maga movement, some of them storm the fucking capital on january sixth, yeah? Absolutely. But if you're a politician you're running in one of these races and you are trying to get voters to choose
between a you and a maga politician. You want to focus all of your attacks possible on the politician themselves and to the extent that you're talking about republican extremism or mega extremism, you want to be, I think, as specific as possible about how that extremism is going to affect your life.
And you were just saying that rights we have to be explicit about the abortion bans explicit about the feather there.
want to overturn elections, explicit about the fact that they're going to privatize social security. So all the things all the freedoms that they're going to take away all the policies that they're going to put into place all the vote that they've taken in the past. You have to be extremely specific about what they are for people and get that message out, and I'm just saying this because, like having having talked to all these voters for the for the wilderness like I was struck by so these were all Biden, voters right, but they have made up their mind.
These are not people who voted for donald trump and twenty twenty. This is part of our coalition and there was not a lot of love for the republican party from these people and a lot of them thought that the republicans are pretty exe.
Cream. There was a lot of discuss with politics, a lot of disappointment about politics and a lot of a feeling about Democrats in general, though it's funny because whereabouts to fetterman and they are in pence in pittsburgh, they all loved fetterman,
but what the people were making up their minds, not just about whether beaufort Democrat verses report,
but whether to vote at all wanted to know what are democrats going to do for me, what is it that republican the republican candidate is going to do that that that republican candidate stands for that is so bad. I don't really pay much attention to the news,
I do feel I politics is very divisive and everyone's yelling at each other in their public and seemed kind of crazy. But, like I don't know, why do I need to go vote at all? And so it is I'm not saying that the white house could have solved chaffinch in one speech that you write. Most of the voters probably did
watch. But I wonder, as we move forward and his democratic candidates, craft thrown message just like house,
pacific. They have to be in like here's, the politician, here's the bad things they're going to do to you and here's what I'm going to do instead. So two points on us: yag agree with the general thrust here. I I think, even if by
said exactly what you wanted him to say. Like a super specifically repeated that distinction a hundred times, the press coverage would look. Ninety five percent, the same agree,
republican sort of have said. Ninety five percent, the same thing
but the two points here are wine, like your
others may vary on whether you want a light independence hall, blood red.

and really great. I thought for quite a while and in living my purpose, a normal life.
Walking miles and miles every day,
going to the grocery store, I'm picking up my kids at their activity,
his arm going
when my wife I'm driving everywhere, so that the truth is that
Nine hundred ninety nine out of a thousand people would have now
idea that I just had a stroke and because I'm living a perfectly normal life and
you have got right out of your being. Her is since
dwayne, acting in a way that I dont believe,
any doctor, should be where they're kind of trying to mark and make fun of somebody that just you had a stroke in

Weirdo celebrity yeah yeah. No one wants that kind of doctrine there
you said yesterday that you're looking forward to debating doctor as his campaign response,
this morning in said, you're lying. You won't say where, and when do you want to settle this here,
it's just the money. We have always said from the beginning that were we're. Gonna have a debate.
the matter of working out through some of the technical issues, is what you, because that's the truth
and we ve been very transparent about that. The entire and the entire time
times. I may not diagnosed something because I have some auditory processing and that's the truth,
and when I am able to make sure I know exactly which heard or what we were talking about. What's through thrilled to be able to talk about,
these issues, and I really think I like issues he has, but I don't think he wants to talk about two.
so you know we're gonna. Have a debate revolves
acknowledge that always and you're after impact.
The melt down after the crudity gate kind of thing he's been shrilling about. You know,
the great debate, even though that we all know that we're going to have a debate in. That's that's really the truth. Do you think it's fair you'll have something of a home field advantage, because the debate will take place in
having your exact I going to say, is that there is a guy that has ten homes
we're matter home ever in pennsylvania and now is just really commuter he's a computer, and it is a computer.
You know and like I'd love, to see what his e pz you know are his records, because I'm sure he's not spending a whole lot of time at his real house here in pennsylvania. It's actually not under it's under construction, but
The truth is the truth. Is there is that doctor oz has a really he's, got a tough, a tough challenge right now too, and that is to bring mega man into the into the fold, because you everywhere
I go across and pennsylvania, I run into to a lot of republicans that come up to say,
I do not say hey, you know like them,
again, I'm gonna both for you, though, because you know that you're on
he's a fraud or ease ease a weirdo from here. He doesn't understand my life and

the people that are going to vote for him or doing at these because they have an hour after his name yet either. Not anyone really believes that he's the kind of person to to direct represent link.
So I have to ask what was your reaction when you first saw the crudity video first one I was like hey dude, you know there is no place called wingers, you know, and and and the next thing was like what the hell's a crudity and then like a stroke, a stroke joke. I was like
I didn't hear that a child and- and I I had somebody I was like you know- what's that word in- and someone on the steps that it's called a crude attack and they texted it, and I was like
Nine I googled it and I like, and I just left and unlike well.
No, you learn. Everything in every election in crudity is one of them and what's really funny to is that I tell people it's a joke. I tell people
sometimes after the stroke. I will most your words together. There really don't exist, and I said
doctor, as did the same thing is like he, you heard of wagons any

You know the rs campaign has been pretty transparent. That they're going to try to get

When you talk about some of his associates,

there's a guy. That is probable. Pro pardoning.
The insurrectionists injured from January six. But here
the guy. Now that is bashing us for giving pardons for people that have some stupid. We charge is as well
and they are trying to scare mongering underlying. I mean that's really all they have and the two people,

roundly believe that he is innocent in these poor man lost almost three decades there decades of there,
I've heard something that there have not done and as
I I made making sure they're getting out was one of the most important things have ever done in my career and we got them out, and I went
to hire them, because their story is important because that's really the truth about second chances and that's the talk about our criminal justice system too,
and now with those two men, the warden,

Then after they get out, they said they are. The two finest men in the entire deal see right now and

having their lives ruined by a charge, I'm also
talking about the revenue yeah I'd rather haven't it come to pennsylvania treasury, then the cartels,
I would want to make sure that its now a pure product, too,

I am just going to try to reach out to them. By just being who I am and running on what I really believe in and running on the right side. Of all these issues, too.
